Cathleen has practiced law for over 30 years with the last 26 years focused on family law and civil litigation. She was counsel on a successful Court of Appeal case that became a leading case in Canada, with respect to a parent’s right to move with their child. She recently won a case in the Court of Appeal Chambers precluding the opposing party from commencing an appeal of family law parenting orders due to the extreme prejudice that would result to her client. Cathleen is an experienced mediator and has also worked directly with parties without counsel resulting in considerable cost savings.

Cathleen is an empathetic listener and strongly listens to her clients’ interests. She has an uncomplicated straightforward approach to matters and ensures information is conveyed to her clients with clarity and understanding. Cathleen can draw on the broad range of practice areas from early in her career that complements her family law practice.

Cathleen is keen to keep her clients out of court wherever possible and is very skilled at negotiation. She encourages her clients to consider resolving their family law matters though Alternate Dispute Resolution methods prior to litigation.  However, in those cases where court is required, Cathleen has extensive experience at every level of court and is determined to advance her clients’ claims to the fullest extent. Cathleen recently had Protection Orders against two of her clients not renewed, in one instance through negotiation, and in the other by court order, which exemplifies her skill set at effecting results consensually or through litigation.

Approach

Cathleen restricts her practice to family law and mediation, with particular strength in high conflict cases. She has resolved matters that clients struggled with for years before retaining her.

Wherever possible, Cathleen keeps her clients out of court. She is a skilled negotiator who encourages resolution through Alternate Dispute Resolution methods, including mediation, before turning to litigation.

When court is required, however, she brings extensive experience at every level and is determined to advance her clients’ claims to the fullest extent. Cathleen has been the successful counsel on numerous cases in the British Columbia Supreme Court and the Court of Appeal, some of which are as follows:

  • Dhillon v. Sadhra 2025 BCCA 290 (CanLII) – successful counsel on a case dismissing an application for an extension of time to file leave to appeal on parenting time orders, in part, due to extreme prejudice to her client;
  • Dhillon v. Sadhra 2025 BCSC May 20, 2025a decision where a protection order was not renewed and interim parenting time was awarded to Cathleen’s client;
  • Nunweiler v. Nunweiler  2000 BCAA 300 CanLII – a decision in which the court allowed Cathleen’s client to relocate anywhere in addition to awarding her client court costs at every level of court;
  • Rice v. Chan Estate 1998 CANLII 3978 (BCSC)a liability decision where the court found that the defendant owed a duty of care to the plaintiff that he breached when exposing her to carbon monoxide poisoning and the plaintiff suffered brain damage as a result;
  • Anthonysz v. Fry 1999 CanLII 5906 (BCSC)a decision where a driver of logging truck was found liable for a no-contact accident that caused Cathleen’s clients off the road resulting in injuries and damages, and clients were awarded double costs.

Personal life

Cathleen McClughan was born and raised in White Rock/South Surrey, graduated from Semiahmoo Senior Secondary and embarked on tennis scholarships in Texas and Oklahoma.  Upon graduation from Cameron University, she worked as a weekend reporter/Crimestoppers director at a local ABC affiliate in Oklahoma when she decided to come back home and attend UBC Law School.

After graduation from UBC Law, she worked downtown for a boutique personal injury firm and soon ventured out on her own and operated her law firm in White Rock for over 22 years where she credits her long-term legal support team as significant contributors to her success.  Cathleen has practiced primarily family law and personal injury litigation, and she obtained her accreditation as a Family Law Mediator in 2013 and strongly believes that the intensive mediation courses were the most valuable of her post law school education.

Cathleen has been fortunate to have unlimited support from her family, and she is very proud of her kids. She appreciates and values their resilience, free thinking, and capacity to take on the world even if they may not fully realize it yet.

Cathleen recently attended a college reunion that honored her tennis coach. Coach Jones told her that she was the most competitive player he had ever coached. Back in the day she would have worn that comment as a badge of honor although upon hearing it now she wondered if perhaps that was actually scary. However, Cathleen deploys her competitive spirit and Kobe-like preparation for good, so these attributes are definitely beneficial for her clients.

Cathleen has taken a keen interest in Protection Orders and has been very successful at getting them set aside either by court order or by consent of the other party. She is equally capable of having Protection Orders put in place where there is family violence. She is also interested in cases involving parental alienation and is familiar with family reunification counselling and systems.
