Moradkhan v. Mofidi [2011] B.C.J. No. 1624 (Written Reasons)

Property Division, the Importance of Obtaining Proper Valuation, Spousal Support

In this case, a final judgment had already been rendered providing the wife with 55% of the family assets and the husband with 45%.

The problem however was the fact that the parties’ properties were not valued properly. We argued that the wife had provided BC assessed values for multi-million dollar properties which were in reality worth much higher than their BC assessed values.

The judge changed her decision and ordered all of the properties sold in order to better determine their value and to provide a fair division between the parties.

Please note that this case was appealed by both sides.
