Do I need a lawyer for my family law case in British Columbia?

If there is any way for your to afford a lawyer or be approved for governmental assistance with your case, we strongly urge you to hire one. Lawyers are trained for years to know the procedure, the law and the proper arguments on your behalf.

Litigation is extremely complicated and requires information and knowledge you cannot find on Google. In fact, most online information and/or samples of agreements found online do very little to protect you because they do not comply with the laws of BC.

How much do I have to pay for legal fees?

This is very difficult question because every case is different. However, you should know that litigation is very very expensive. If you decide to litigate or hire a lawyer, you must ensure you have the proper budget to do so. And by that we mean enough budget to take you through trial if trial becomes necessary.

Is there such thing as legal separation?

No. You may report your separation date through filing for a family law case. The only thing legal, however, is divorce which can only be granted by a judge.

Do I have to go to Court to obtain a BC Divorce?

Yes. The only person who can grant you a divorce is a judge and therefore you must file your claim for divorce with the Courts.

You or your spouse must also be living in BC for at least one year immediately prior to commencing your divorce claim.
